Death row inmate Robert Roberson, who faces the prospect of becoming the first person in the U.S. to be executed for a “shaken baby” death, was a no-show Friday at a hearing before a Texas state House committee where he was supposed to testify.

The last-minute filing marks the second time the attorney general has sought to keep Roberson from testifying at the Capitol about his conviction.

Death row inmate Robert Roberson III will not appear Friday at a Texas House hearing, the chair of the committee holding the hearing said. Roberson, 58, was set to testify before the House Committee on Criminal Jurisprudence after the committee’s chair issued a subpoena Tuesday.
