Border Patrol commander Gregory Bovino will not have to appear before a Chicago federal judge Wednesday evening, after an appeals court halted the judge’s order requiring Bovino to provide daily court briefings on his agents’ immigraton enforcement tactics in the Chicago area.

The use of tear gas along residential streets, in particular, has become a point of contention seven weeks into the administration’s crackdown in Chicago.

The ruling comes a day after the commander attended federal court to address questions about a series of aggressive immigration actions.
